This website and online store are operated by Frédéric Duclos — Silver Extraordinaire® ("we", "us", "our"). The store is powered by Shopify. By visiting this site or placing an order you agree to these Terms of Service ("Terms"). Please read them carefully. If you do not agree, please do not use the site.

1. Using the site

You agree to use this site only for lawful purposes and in a way that does not infringe the rights of others or restrict their use of the site. We may update the site, its content and these Terms at any time; the version posted on the site when you use it applies.

2. Products, descriptions and prices

Our jewelry is designed in California and hand-finished in Italy from sterling silver, with rhodium, yellow gold or ruthenium plating and, on some pieces, natural gemstones. We make every effort to show colors, finishes and sizes accurately, but screens vary and small differences may occur. Prices are shown in U.S. dollars and may change without notice. We reserve the right to correct pricing or description errors and to cancel an order affected by one, in which case you will be refunded in full.

3. Orders and payment

Placing an order is an offer to buy. We may accept or decline any order, in whole or in part. Payment is taken at checkout through Shopify's secure checkout; we do not store your full payment card details. Taxes and shipping, where applicable, are calculated at checkout.

4. Shipping

We currently ship within the United States only. Your jewelry is shipped within 4 business days of receipt of your order. Depending on your location, delivery by UPS typically takes 2–7 days. If a style is out of stock, we will contact you. Risk of loss passes to you when the carrier delivers the package.

5. Returns, exchanges and warranty

Our Returns page and Warranty page form part of these Terms. In summary, jewelry must be returned in its original, unused condition and shipped within 14 days of the invoice date for a refund or credit (less shipping cost), and pieces purchased directly from this website carry a one-year limited warranty as described on the Warranty page. 6. Intellectual property

All content on this site — including the Frédéric Duclos® and Silver Extraordinaire® names and logos, designs, photographs, videos, text and graphics — is owned by us or our licensors and is protected by trademark, copyright and other laws. You may not copy, reproduce, modify, distribute or use it for commercial purposes without our prior written permission.

7. Accounts, wholesale access and communications

The retailer (wholesale) portal is available to authorized retailers only and is subject to its own login. If you subscribe to our email list you may unsubscribe at any time using the link in any message. How we handle your personal information is described in our Privacy Policy.

8. Disclaimer of warranties

Except for the limited warranty described on our Warranty page and rights you have under applicable law, the site and its content are provided "as is" and "as available", without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose and non-infringement. We do not guarantee that the site will be uninterrupted or error-free.

9. Limitation of liability

To the fullest extent permitted by law, we will not be liable for any indirect, incidental, special or consequential damages arising from your use of the site or purchase of products, and our total liability for any claim relating to an order will not exceed the amount you paid for that order. Nothing in these Terms limits liability that cannot be limited by law.

10. Governing law

These Terms are governed by the laws of the State of California and the United States, without regard to conflict-of-law rules.

11. Changes

We may revise these Terms from time to time. Continued use of the site after changes are posted means you accept the revised Terms.
